1. Acceptance
By using TCOS or this website, you agree to these Terms of Service and the Privacy Policy. If you do not agree, do not use the service or connect a third-party account.
2. The service
TCOS is a local-first desktop workflow for organizing trading-card operations and preparing, reviewing, and publishing creator-owned content through supported third-party platforms. Features may change as the product and platform requirements evolve.
3. Accounts and authorization
You are responsible for your device, TCOS installation, connected accounts, and all actions approved through them. You may connect only accounts you own or are authorized to manage. You must not circumvent platform permissions, access controls, posting limits, or review requirements.
4. Creator content
You retain ownership of content you provide. You grant TCOS only the limited permission needed to process and transfer that content as you direct. You represent that you have the necessary rights to upload and publish the content, metadata, music, images, trademarks, and other included material.
5. Acceptable use
You may not use TCOS to violate law, infringe intellectual-property or privacy rights, distribute malware, mislead users, manipulate platform systems, send spam, evade platform enforcement, or publish content prohibited by YouTube, TikTok, or another connected service.
6. Third-party services
YouTube, TikTok, AI providers, backup providers, and other connected services are operated by third parties and governed by their own terms and policies. TCOS does not control their availability, review decisions, processing time, account actions, APIs, quotas, or policy changes.
7. Publishing responsibility
You are responsible for reviewing each title, caption, description, tag, audience selection, scheduled time, and content file before approving a publishing action. Automatically suggested text may contain errors and must be reviewed by the creator.
8. Availability and changes
TCOS is provided on an “as available” basis. We may modify, suspend, or discontinue features when necessary for security, compliance, maintenance, or compatibility with a third-party platform.
9. Disclaimer
To the extent permitted by law, TCOS is provided without warranties of uninterrupted operation, error-free output, platform approval, publishing success, audience performance, or preservation by a third-party service. You are responsible for maintaining appropriate copies of important content and records.
10. Limitation of liability
To the extent permitted by law, TradingCardMD will not be liable for indirect, incidental, special, consequential, or punitive damages, lost revenue, lost audience reach, lost content, or third-party account actions arising from use of TCOS.
11. Termination
You may stop using TCOS and revoke connected accounts at any time. We may restrict access when reasonably necessary to address security, legal, platform-compliance, or misuse concerns.
12. Governing law
These terms are governed by the laws of the State of Indiana, United States, without regard to conflict-of-law principles.
